Following the talks held between HBAA and HMRC regarding TOMS the following communique has been agreed.  I hope it clarifies the position and the actions that you need to take.

We have made significant progress since the matter first arose, and many thanks are due from us all to the leaders in this.  David Bennett from Saffrey Champness has been unstinting in his time and effort, acting in his professional capacity as a Tax expert on a pro bono basis for the association.  

Expotel had engaged Deloittes to advise them, and kindly widened their brief to speak on behalf of the HBAA (the strength of  a trade body).  BSI, who were also closely involved in the process, made a contribution to the considerable fees that Expotel incurred with Deloittes.  We owe a great debt of gratitude to Ian Burnley for taking the lead and to Trevor Elswood also for this.

With a team led by Deloittes supported by David Bennett, with Ian and Trevor speaking on behalf of member’s interests and myself bringing up the rear representing the interests of members and partners we were able to present a lucid and compelling case for a workable interpretation of the new rules.  It took time, but was worth the wait.
